29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by a competent person prior to the start of work and as needed throughout the shift:    a) Magic Valley Business Park: On March 16, 2012 and at times prior thereto a competent person had not conducted an inspection as needed through out the work shift to determine the appropriate protective system to use after removing a trench box and prior to allowing employees to re-enter and perform hand digging and pipe installation activities in an eight foot deep excavation. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) Magic Valley Business Park: On March 16, 2012 and at times prior thereto the spoil piles of excavated materials were not placed at least two feet back from the edge of an eight foot deep trench in shich employees performed hand digging and pipe installation activities.
