29 CFR 1910.23(a)(3):   Every hatchway and chute floor opening was not guarded by one of the following: (i) Hinged floor opening cover, (ii) A removable railing with toe board:    (a)  On the third floor of the Mill building, there was chute floor opening measuring 20" by 30" that was not guarded.  (b)  On the #4 Bin roof deck, there were two triangular shaped floor openings that were not guarded.

29 CFR 1910.23(b)(1):   Every wall opening from which there is a drop of more than 4 feet shall be guarded:    (a) On the #4 Bin Deck, there was an inadequately guarded wall opening on the west side in that the top rail was too high (43 1/2 to 44 inches high) and no mid-rail.     (b) In the Mill building, on the 4th floor east side, there was a wall opening that was missing the top rail and the mid rail was too high (25 1/2 inches off the floor).    (c)  In the Mill building on the second floor, there were wall openings on each side of the grain chutes that were not guarded with standard guard railing.

(b) On or about February 3, 2012, Bins #13, 14, 16, and 27 were entered to clean out the bins and emergency rescue equipment was not provided.

29 CFR 1910.304(g)(5):   The paths to ground from circuits, equipment, and enclosures were not permanent, continuous, and effective:    (a)  In the Maintenance shop, the 110v outlet that the bench grinder and the light with a metal shade did not have low impedance paths to ground (2.5 ohms resistance).    (b)  In the Maintenance shop, the two (2) other 110v outlets that were tested also had high impedance paths to ground (4.0 ohms on wall outlet and 2.5 ohms on the outlet mounted on I-beam column).

29 CFR 1910.305(g)(1)(iv)(C):   Flexible cords and cables were run through doorways, windows, or similar openings:    (a) On the #1 Bin Deck, Head House, there was a flexible cord run through a window opening and a hole cut in the screen to power a light at the turn head.    (b) On the #3 Bin Deck, there was a flexible cord run through a doorway with a metal door to power the temperature monitor sending unit.

29 CFR 1910.305(g)(2)(iii):   Flexible cords and cables were not connected to devices and fittings so that strain relief was provided that would prevent pull from being directly transmitted to joints or terminal screws:    (a) In the Maintenance building, there was a flexible cord powering the old pedestal fan that did not have strain relief at the fan motor connection and was pulled loose, as well as having damage to the outer insulation in the length of the cord.

29 CFR 1910.24(e):   Fixed stairs were not installed at angles to the horizontal of between 30deg. and 50 deg. Any uniform combination of rise/tread dimensions may be used that will result in a stairway at an angle to the horizontal within the permissible range. Table D-1 gives rise/tread dimensions which will produce a stairway within the permissible range, stating the angle to the horizontal produced by each combination:  (However, the rise/tread combinations are not limited to those given in Table D-1).    (a)  In the Mill building, there was a metal stairway between the second and third floors that was too steep (approx. 60 degrees).
