St., Lawrence, Kansas, 66044 the employer did not have a safety and health program.  Employees were exposed to hazards associated with roofing work such as, but not limited to, falls from roofs and ladders, struck by hazards, etc.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.    At the worksite located at 1510 N. 3rd. St., Lawrence, Kansas, 66044 the employer did not ensure employees working on the ground were wearing hard hats when overhead work was being conducted.  Employees were exposed to struck by hazards.

29 CFR 1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.    At the jobsite located at 1510 N. 3rd. St., Lawrence, Kansas, 66044 ,employees were engaged in roofing activities on a variable pitch roof (12 in 12 and 14 in 12) without the use of fall protection.  Employees were exposed to falls of approximately 18 feet eave to ground.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    At the jobsite located at 1510 N. 3rd. St., Lawrence, Ks., 66044 the employer had not develop or implemented a fall protection program to train employees on the recognition of fall hazards, to include procedures to to follow in order to minimize these hazards.  Employees were exposed to fall hazards of approximately 18 feet from eave to ground.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    At the jobsite located at 1510 N 3rd. St., Lawrence, Kansas, 66044 the employer did not ensure ladders being used to access the roof on the west side of the roof extended at least three feet above the roof eave. Employees were exposed to fall hazards of approximately 18 feet eave to ground.

29 CFR 1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly.    At the jobsite at 1510 N. 3rd. St., Lawrence, Ks., 66044 the employer did not conduct an expose assessment before starting work.  Employees were exposed inhalation and other health hazards associated with roofing shingles being removed that contained between 15% to 25% Chrysotile asbestos.

29 CFR 1926.1101(g)(8)(iii)(A): Cutting, abrading or breaking roof  shingles, shall be prohibited unless the employer can demonstrate that methods less likely to result in asbestos fiber release cannot be used.    At the jobsite located at 1510 N. 3rd. St., Lawrence, Ks., 66044 the employer allowed employees to improperly handle roofing shingles containing Chrysotile asbestos in that they were breaking shingles when removing them from the roof and they were throwing them from the roof of the building to the ground causing shingles to break. Employees were exposed to inhalation and health hazards associated with the possible release Chrysotile asbestos fibers.

29 CFR 1926.1101(k)(9)(i): The employer shall train each employee who is likely to be exposed in excess of a PEL, and each employee who performs Class I through IV asbestos operations, in accordance with the requirements of this section. Such training shall be conducted at no cost to the employee. The employer shall institute a training program and ensure employee participation in the program.    At the jobsite located at 1510 N. 3rd. St., Lawrence, Kansas, the employer did not provide training on asbestos operations, such as removing and handling roof materials containing Chrysotile asbestos. Employees were exposed to inhalation and other health hazards assocated with Chrysotile asbestos.
