29 CFR 1926.602(c)(1)(ii):     No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced.    At the worksite:  On or about March 9, 2012, and at times prior thereto, the employer conducted work using a Caterpillar Telehandler (rough terrain forklift), model TH-83 to support an elevated work platform attachment without approval from the manufacturer.  The employee was exposed to the hazard of fall from heights.

29 CFR 1910.178(m)(5)(ii):    A powered industrial truck was unattended when the operator was 25 feet or more away from the vehicle which remains in his view, or whenever the operator leaves the vehicle and it is not in his view:      At the worksite:  On or about March 9, 2012, and at times prior thereto, the employer conducted work from an elevated work platform supported by a rough terrain type forklift while it was unattended.  The employer was exposed to the hazard of fall from heights.

29 CFR 1926.451(g)(1):    Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level by guardrail systems, personal fall arrest systems or other designed fall protection:    At the worksite:  On or about March 9, 2012, the employer climbed in and out of a work platform supported by a rough terrain type forklift to gain access to the ladder on the outside of the guardrail.  This ladder was used to gain access to the elevated work platform level.  The employee was exposed to the hazard of fall from heights.
