29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Outside of the structure: On March 16, 2012 and at times prior thereto, employees performed framing activities on a 10 in 12 pitched roof without a fall protection system in place. b) Inside and outside of the structure, upper levels: On March 16, 2012 and at times prior thereto, multiple open sided floors did not have a fall protection system in place. These locations included, but were not limited to the opening at the top of main stairway inside, a opening at the stairway in the garage, and the outdoor patio area. c) Inside the structure, all levels: On March 16, 2012 and at times prior thereto, multiple window openings that were less than 39 inches high, did not have a guardrail or other barrier in place at 39 inches. These locations included but were not limited to, either side of the entryway and in the library area. d) Inside the structure, main floor level: On March 16, 2012 and at times prior thereto, a floor opening for the multi-level fireplace did not have a guardrail system in place. Note) Abatement certification is NOT required for this item.
