Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lift parts: (a) On or about March 21, 2012, for the employees working around and under the Rotary 2-post lifts, Model #SL90100, with a 9,000 lbs. capacity, with safety locks that were not operational at Sharp Chevrolet, located at 1112 Ninth Avenue SW in Watertown, South Dakota. (b) On or about March 21, 2012, for the employees working around and under the Worth 2-post above ground lifts, Model #9000 ACF, with a 9,000 lbs. capacity, with the lifts not lowered onto the safety locks, leaking hydraulic cylinder, and sagging lift arms at Sharp Chevrolet, located at 1112 Ninth Avenue SW in Watertown, South Dakota. (c) On or about March 21, 2012, for the employees working around and under the Rotary 4-post above ground lift, Model #ARO123-10, Serial #JAUo4H0008, with a 12,000 lbs. capacity, with the front runway stops missing at Sharp Chevrolet, located at 1112 Ninth Avenue SW in Watertown, South Dakota.
