29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Worker was engaged in commercial construction activities installing wood framing on the perimeter of a flat metal deck section attached to the main building structure of the new Menard's store, did not use conventional or personal fall protection systems. The worker was at that unprotected side or edge measuring, marking, and laying out for wood perimeter plate at a height of 15 feet and greater above the lower ground level.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. a) The employee who worked off a flat metal deck section that was attached to the main building structure of the new Menard's store, did not have the knowledge to determine and to distinguish that the installed metal deck surface transitioned from the 29 CFR 1926.750 Subpart R standards requirements and required a fall protection system to be implemented at six feet and greater above the lower ground level under 29 CFR 126.500 subpart M.
