29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:  NOTE: A sign reading DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.    On or about the month of March, 2012, employees entered underground drags without designating these locations as permit required confined spaces.        Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:      On or about the month of March, 2012, employees entered the underground drag areas for housekeeping and maintenance inspection performed on a monthly basis. The employer failed to develop and implement a written permit space entry program for these areas prior to permitting employee access.      Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.146(c)(5)(ii)(C): Employees entered into permit spaces that met the conditions set forth in 29 CFR 1910.146(c)(5)(i) but before an employee entered the space, the internal atmosphere was not tested with a calibrated direct-reading instrument.    On or about the month of March, 2012, employees entered the underground drag areas for housekeeping and maintenance inspection performed on a monthly basis without verification that the atmosphere was safe for entry.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.146(e)(1): Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit:  Note:  Appendix D to 29 CFR 1910.146 presents examples of permits whose elements are considered to comply with these requirements.    On or about the month of March, 2012, employees entered underground drags without completion of an entry permit that would document measures had been taken such as, but not limited to, testing the atmosphere to verify that a safe entry could be made into the work area.       Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
