29 CFR 1910.178(l)(1)(i):     The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a)  178 Littleton Road, Morris Plains, NJ and at the Corporate Offices at 927 Rahway Avenue, Avenel, NJ.    The operator of the Sky Trak Model 10054 Rough Terrain Forklift who was lifting a worker on the tines of his forklift with a makeshift platform had not received training and evaluation on powered industrial trucks as specified in paragraph (l).                            Violation observed on or about 03/17/2012.

29 CFR 1926.451(c)(2)(iv):     Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:      a)  171 Littleton Road, Morris Plains, NJ.    The employer used the rough terrain forklift to support the makeshift scaffold platform when neither were designed by the manufacturer for that purpose exposing employees to falls and struck-by hazards.                      Violation observed on or about 03/17/2012.

29 CFR 1926.451(c)(2)(v):     Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:      a)  171 Littleton Road, Morris Plains, NJ.    The employer used the rough terrain forklift to support the makeshift scaffold platform which was not secured in any way to the tines of the forklift while raising the worker to a 20 foot height and moving the worker horizontally along the eave of the roof so that the worker could attach the fascia.                      Violation observed on or about 03/17/2012.

29 CFR 1926.451(g)(1):     Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:      a)  171 Littleton Road, Morris Plains, NJ.    The employee was exposed to falls of 20 feet to the ground below from the rough terrain forklift's makeshift platform as no means of fall protection were in use.
