29 CFR 1910.178(l)(2)(iii): All operator training and evaluation shall be conducted by persons who have the knowledge, training, and experience to train powered industrial truck operators and evaluate their competence. a. Throughout the facility, the employer failed to ensure that Powered Industrial Vehicle (Forklift) training was conducted by an individual that was properly trained and experienced in the training of new operators. The lack of qualified training thereby exposed employees to a struck-by hazard.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics shall be provided to the operator when the operator has been involved in an accident or near-miss incident: a. Refresher training had not been provided to employees operating forklifts who were involved in multiple accidents. Two "Rework" employees had been involved in a two forklift collision during warehouse operations. Another employee struck a structural member (an upright pole) with the forklift being operated. There have been numerous loads "dropped" during forklift operations due to excessive speed, sharp turning, rapid stopping, or other improper movements. The lack of refresher training thereby exposed employees to a struck-by hazard.
