29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: (a) No energy control procedure had been developed to protect maintenance mechanics from the hazards associated with unexpected start up of buses (e.g., GIllig and Nova) during maintenance and/or repair performed in the Maintenance Garage. These buses did not require a key for start up. These buses contained contained multiple types of hazardous energy, such as but not limited to electrical, mechanical, and gravitational.

29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices: (a) In regards to maintenance repair work performed on Gillig and/or Nova buses in the Maintenance Garage, necessary training was not provided to enable maintenance mechanics to safely apply, utilize, and remove energy controls. Training was not provided regarding types and magnitude of the hazardous energy sources (such as, but not limited to electrical, mechanical, and gravitational) associated with these buses, and training was not provided regarding procedures necessary for energy isolation and control.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) No written hazard communication program had been developed for workers who use a variety of hazardous chemicals. For example, Assistant Mechanics in the Wash Rack area use cleaning chemicals, including DC-99, Amway Multi Purpose, and Klearview Window Cleaner. Workers have experienced eye irritation and swollen eyes while working with these chemicals. These workers also handled fuel(s), and sometimes experienced eye irritation associated with that task.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein: (a) In the Wash Rack area, portable spray bottle containers of DC99 Degreaser, Amway Multi-Purpose, and Klearview Window Cleaner, were not properly labeled with the idenditity and appropriate hazard warning information. These portable containers were used by more than one worker and for more than one workshift. These chemical products could cause eye and respiratory irritation. DC99 and Klearview Window Cleaner may cause skin irritation. Klearview Window Cleaner contains methanol, which is flammable, and inhalation of excessive concentrations could potentially adversely affect vision.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a. Workers have not been provided training as required by this standard. For example, Assistant Mechanics have to been trained with regard to information available in material safety data sheets. Training has not been provided regarding the physical and health hazards of the cleaning chemicals and fuels they use. b. New chemicals products have been introduced into the workplace without provision of additional training and information. For example, training and information has not been provided regarding Bue Def when that chemical product was introduced a few years ago.
