29 CFR 1926.20(b)(2):     The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.    a)  Lina Lane, Eastampton, NJ:  Employee was exposed to a fall hazard greater than 25 feet while erecting a steel frame commercial building from a scissor lift scaffold with inadequate guard rail.  The employer had not initiated a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition.  Observed on or about 03/21/2012.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1):     Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a)  Lina Lane, Eastampton, NJ:  Employee was exposed to a fall hazard greater than 25 feet while erecting a steel frame commercial building from a scissor lift scaffold with inadequate guard rail.  The employee was not provided adequate alternate fall protection (PFAS, safety nets, etc.) for this site.  Observed on or about 03/21/2012.    NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.100(a):     Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a)  Lina Lane, Eastampton, NJ: :  Employee was exposed to overhead struck-by hazards while erecting a steel frame commercial building from a scissor lift scaffold.  The employee was noted to be working in close proximity and at times under a suspended beam.  The employee was not protected from impact by a hard hat.  Observed on or about 03/21/2012.    NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
