Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to struck-by and crushing hazards which could inflict death or serious injury while handling granite slabs: (a) Granite and Marble Designs LLC at 650 E 49th Ave, Denver, CO 80216: On and before March 16, 2012, the employer did not follow safe slab handling procedures while transporting and maneuvering granite slabs. Employees were observed standing in the fall zone on multiple occasions in order to lock the clamp in place in order to move the slabs between the storage racks and the bridge saw. This condition exposed the employees to struck-by and crushing hazards. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: (1) A slab wedge can be used to separate the granite slabs from one another by having two employees stand to the side of the slab and insert the wedge so that a clamping device can be placed onto the slab to be moved. (2) Institute and enforce a policy in which employees are prohibited from standing or putting any portion of their body in the fall zone of slabs. (3) Conduct employee training of safe handling procedures to ensure they fully understand the dangers of putting any portion of their body to the side of a moving and/or unsecured slab and the safe methods of maneuvering slabs. 29 CFR 1910.134(c)(1): A written respiratory protection program with worksite specific procedures, as specified in subparagraphs (c)(1)(i) through (ix) of this section, was not established and implemented where respirator(s) were necessary to protect the health of the employee or whenever respirator(s) were required by the employer: (a) Granite and Marble Designs LLC at 650 E 49th Ave, Denver, CO 80216: On and before March 22, 2012, the employer did not ensure a worksite specific written respiratory program was established and implemented in the workplace when the use of respirators was required during fabrication tasks. The employer requires the use of Moldex dust masks for fabrication operations which include, but are not limited to, sawing, routing, and polishing. The employer requires the use of a 3M half-mask elastomeric respirator for dry grinding and dry cutting fabrication operations. All these operations generate respirable silica. On March 22, 2012, one employee performing dry cutting and dry grinding on granite and engineered stone slabs was exposed to respirable silica at a concentration greater than the 8-hour TWA Permissible Exposure Limit (PEL) of 0.48 milligrams per cubic meter. The employee was exposed to respirable silica at a concentration of 5.168 milligrams per cubic meter as an 8-hour TWA. This is 10.77 times the PEL. Air monitoring was conducted for 493 minutes. (b) Granite and Marble Designs LLC at 650 E 49th Ave, Denver, CO 80216: On and before March 22, 2012, the employer did not ensure a worksite specific written respiratory program was established and implemented in the workplace when the use of respirators was required during fabrication tasks. The employer requires the use of Moldex dust masks for fabrication operations which include, but are not limited to, sawing, routing, and polishing. The employer requires the use of a 3M half-mask elastomeric respirator for dry grinding and dry cutting fabrication operations. All these operations generate respirable silica. Abatement Note: The employer shall include in the program the following provisions of 29 CFR 1910.134 as applicable: (1) Procedures for selecting respirators for use in the workplace; (2) Medical evaluations of employees required to use respirators; (3) Fit testing procedures for tight-fitting respirators; (4) Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations; (5) Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators; (6) Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators; (7) Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations; (8) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and, (9) Procedures for regularly evaluating the effectiveness of the program. On March 22, 2012, one employee performing dry cutting and dry grinding on granite and engineered stone slabs was exposed to respirable silica at a concentration greater than the 8-hour TWA Permissible Exposure Limit (PEL) of 0.48 milligrams per cubic meter. The employee was exposed to respirable silica at a concentration of 5.168 milligrams per cubic meter as an 8-hour TWA. This is 10.77 times the PEL. Air monitoring was conducted for 493 minutes. Abatement Note: Feasible engineering controls include, but are not limited to: (1) Provide local exhaust ventilation either by installation of local exhaust ventilation at each work station capable of generating airborne dust, or by use of a vacuum system right angle head grinder. (2) Use wet methods to reduce airborne respirable particles. Abatement Note: Abatement of this item will normally be multi-step as follows: (1) Effective respiratory protection shall be provided and used by exposed employees as an interim protective measure until feasible engineering and/or administrative controls can be implemented or whenever such controls fail to reduce employee exposure to within exposure limits. STEP 1 ABATEMENT DATE (15 DAYS): X (2) Submit to the Area Director a written detailed plan of abatement outlining a schedule for the implementation of engineering and/or administrative measures to control employee exposures to the hazardous substance referenced in this citation. The plan should include, at a minimum, target dates for the following actions which should be consistent with the dates required by this citation: (a) Evaluation of the extent and location of the hazard source; (b) Evaluation of control measure options; (c) Selection of optimum control measures; (d) Determination of control measure designs; (e) Ordering and delivery of equipment; (f) Installation of control measures; (g) Training of employees in proper operation and maintenance of newly implemented control measures; and, (h) Assurance of the effective performance of control measures. All control measures shall be evaluated for each particular use by a competent Industrial Hygienist or other technically qualified person. Thirty day progress reports are required during the abatement period. The progress report must identify the action taken to achieve abatement and the date the action was taken.
