29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: The employer failed to provide an egress ladder within a trench that measured at least 5 feet, 2 inches in depth. Workers were exposed to a cave-in hazard. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: No person conducted an inspection of the excavation in which an employee was verifying a utility at this job site. The employee was working in a trench that measured approximately 5 feet, 2 inches in depth (near where the employee was observed working), at least 3 feet in width, and at least 15 feet in lenght. The excavation side walls and end walls were vertical and the side walls were composed of clay like soil of type B consistency. No benching, shoring or sloping of excavation walls had been done. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).
