29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: WORKSITE: The employees working and walking around in the trench trying to locate the water main were not protected from trench wall cave-in that measured approximately 24 feet long, by approximately 7'-5" wide and between 8' and 10'-2" deep by use of adequate andappropriate protective systems and/or other safe means.

29 CFR 1926.651(j)(2): Employee(s) were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. WORKSITE: The employees, working and walking in the trench to locate the water main were not protected from the hazards of excavated materials and soils from rolling or falling into the trench. DeRita & Sons Construction Co., Inc., was previously cited for a violation of this occupational safety and health standard (29 CFR1926.651 (j) (2)), which was contained in OSHA inspection number 312402175, citation number 1, item number 1, affirmed as a final order on 1/14/2009, with respect to a workplace located at Corner of Bow Lane & Saybrook Road, Middletown, CT 06457.
