29 CFR 1926.451(e)(6)(i): Prefabricated scaffold access frames shall be specifically designed and constructed for use as ladder rungs: (a) Benerito Velasquez at 520 Colorado Blvd., Denver, Colorado 80206: On and before March 22, 2012, the exposing employer did not ensure that fabricated access frames were specifically designed and constructed for use as ladder rungs, in that employees climbed scaffold frames to access both tiers of the scaffold used at the jobsite. The scaffold frames were not designed to be used as a scaffold ladder access. This condition exposed employees to the hazard of falling from heights of approximately 13-14 feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level: (a) Benerito Velasquez at 520 Colorado Blvd., Denver, Colorado 80206: On and before March 22, 2012, the employer did not ensure that employees were protected from a fall from elevation in that guardrails or other suitable fall protection were not properly installed on the working platform of the scaffolding. The scaffold used on the front side of the residential home lacked midrails, toprails, and endrails. This condition exposed employees to a fall of approximately 13-14 feet.

Two employees erected a scaffold section that was two-frames wide, two-levels high in front of the residential building without the supervision of a qualified competent person. This condition exposed employees to falls of approximately 13-14 feet.
