OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible paper dust deflagration, explosion or other fire hazards while working at or near an indoor dust collector (bag house) which was not adequately designed to prevent or minimize employee exposure in the event of deflagration or other uncontrolled fire event: Baled News Warehouse: On or about March 27, 2012, the indoor Air Equipment & Engineering Inc. pneumatic pulse type bag house dust collector handling combustible paper dust lacked means of (1) explosion protection and (2) fire protection. AMONG OTHER METHODS, A FEASIBLE METHOD TO CORRECT THIS HAZARD WOULD BE TO COMPLY WITH NATIONAL FIRE PROTECTION ASSOCIATION (NFPA) STANDARD 654 "STANDARD FOR THE PREVENTION OF FIRE AND DUST EXPLOSIONS FROM THE MANUFACTURING, PROCESSING, AND HANDLING OF COMBUSTIBLE PARTICULATE SOLIDS (2006)" SECTIONS 7.1.2; 7.13.1.1; 7.13.1.2; 7.13.1.3.1; 9.1.1.1; 10 AND/OR TO COMPLY WITH FM GLOBAL PROPERTY LOSS PREVENTION DATA SHEETS 7-76 "PREVENTION AND MITIGATION OF COMBUSTIBLE DUST EXPLOSIONS AND FIRE (2006)" SECTIONS 2.3; 2.4 AND 2.5 AND 7-73 "DUST COLLECTORS AND COLLECTION SYSTEMS (2008)" SECTION 2.1. SPECIFICALLY, THESE METHODS FOR EXPLOSION PROTECTION INCLUDE, BUT ARE NOT LIMITED TO, THE FOLLOWING: (1) LOCATE THE DUST COLLECTOR IN A SAFE LOCATION OUTDOORS AND PREVENT DEFLAGRATION PROPAGATION BACK INTO THE FACILITY VIA A LISTED DEFLAGRATION ISOLATION DEVICE; OR (2) EQUIP THE INDOOR DUST COLLECTOR WITH DEFLAGRATION VENTING THAT IS VENTED THROUGH DUCTS TO THE OUTSIDE OF THE FACILITY IN ACCORDANCE WITH NFPA 68 "STANDARD ON EXPLOSION PROTECTION BY DEFLAGRATION VENTING", OR (3) INSTALL DEFLAGRATION SUPPRESSION SYSTEMS IN ACCORDANCE WITH NFPA 69 "STANDARD ON EXPLOSION PROTECTION SYSTEMS". METHODS FOR FIRE PROTECTION INCLUDE, BUT ARE NOT LIMITED TO, AUTOMATIC SPRINKLER PROTECTION WITHIN THE DUST COLLECTOR ITSELF.
