29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    a) AcuSport Corporation - Bellefontaine, Ohio: On or about March 6, 2012, the employer did not assure that employees were protected from falls when accessing upper level shelves to obtain and/or organize product.  Employees were exposed to a fall hazard of approximately 12-feet.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) AcuSport Corporation - Bellefontaine, Ohio: On or about March 27, 2012, employees operated powered industrial vehicles to lift and/or maneuver materials in the warehouse and shipping dock areas.  The employer did not assure employees were trained in the safe operation of forklifts.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

Employees operate forklifts daily to load and unload trucks.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
