29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    (a) Location:  27-29 Bowers St., Lowell, MA:  On or about March 22, 2012, employees were not provided fall protection while performing roofing work and exposed to a fall greater than 24 feet above pavement.

29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a) Location:  27-29 Bowers St., Lowell, MA:  On or about March 22, 2012, the employer did not provide adequate or effective training to employees exposed to fall hazards of greater than 24 feet while performing roofing work to recognize proper necessary proceduress to minimize the exposure.

29 CFR 1926.1060(a):     The employer did not provide a training program for each employee using ladders and stairways, that enabled each employee to recognize hazards related to ladders and stairways, and that trained each employee in the procedures to be followed to minimize those hazards:    a) Location - 27-29 Bowers St., Lowell, MA:  On or about March 22, 2012, employees were not adequately or effectively trained to recognize proper erection of extension ladder(s).  Employees were exposed to fall hazards while dismounting and mounted the ladder approximately 25 feet above asphalt paving.

29 CFR 1926.1053(b)(1):     Where a portable ladder(s) was used for access to an upper landing surface and/or the ladder length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist emmployees in mounting and dismounting the ladder:    a) Location - 27-29 Bowers St., Lowell, MA:  On or about March 22, 2012, the metal extension ladder used to access the roof did not extend beyond the roof bracket platform (upper landing) at least three feet nor was a grasping device provided , exposing employees to a fall of 24 feet or greater.

29 CFR 1926.1053(b)(8):     Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder.    a) Location - 27-29 Bowers St., Lowell, MA:  On  or about March 22, 2012, a metal extension ladder for roof access by employes and placed in front of buliding access stairs and door was not secured to prevent displacement or barricaded.
