North American Coatings LLC dba CL Industrial Coatings Inc. Moffett Federal Airfield Hanger 1 - On or about March 26, 2012 and at times prior thereto, an employee was not wearing prescription and/or safety glasses with side shields while being fit-tested for a half mask respirator.

29 CFR 1926.102(a)(1): Eye and face protective equipment was not provided when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.      OR IN THE ALTERNATIVE    1926.28(a):The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employee.    a.  North American Coatings LLC dba CL Industrial Coatings Inc. Moffett Federal Airfield Hanger 1 - On or about March 26, 2012 and at times prior thereto, an employee received burns and/or skin irritation and/or allergic skin reactions and/or sensitization to his face requiring medical attention and days away from work after three 10 hour days of spraying a mixture of, Carbomastic 15 Part A and Part B, and and Thinner 10.  He was given a half mask respirator and safety glasses with side shields to wear over his prescription glasses.  The Job Hazard Analysis (AHA 13) indicated he needed a full face respirator or a half mask respirator with a face shield.  Other employees were given a full face respirator.

29 CFR 1904.4(a): Each employer required by this part to keep records of fatalities, injuries, and illnesses did not record each fatality, injury and illness that was work-related, a new case and met one or more of the general recording criteria of 1904.7 or the application to the specific cases of 1904.8 through 1904.12 and/or the employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent.    North American Coatings LLC dba CL Industrial Coatings Inc., Moffett Federal Airfield Hanger 1 - On or about March 7, 2012, CL Industrial Coatings Inc. foreman/supervisor was advised by an employee that they could no longer spray (mix of Carbomastic 15 Parts A and B, with Thinner 10) as it was causing too much stinging and burning to their face and requested to be transferred to Zone 3 to brush and roll the product.      a.  Employee was moved to brush and roll on March 8, 2012 and met the requirement for recording under 29 CFR 1904.7(b)(4)(i)(A) due to restricted work.    b.  On Monday March 12, 2012 the employee, who had sought medical treatment for work related burns/skin irritation/allergic skin reaction the previous Friday (3/9/2012) and received two prescriptions and a return to work with restriction of no exposure to chemicals, contacted his supervisor/foreman to advise he was unable to return to the worksite that day (Monday March 12, 2012) as his face was burning too badly to even wear personal glasses for most of the day without a cushion between his skin and nose making it recordable under 29 CFR 1904.7(b)(3)     c.  On Tuesday, March 13, 2012 the employee returned to the worksite to obtain workers compensation paperwork and provide the return to work (RTW) with the restriction of no exposure to chemicals and information employee received two prescriptions to the project superintendent for CL Industrial Coatings Inc.  The employer did not accept the RTW or any other information on medical determination as the employee was fired and advised to get off the premises as soon as they entered the office trailer.  (29 CFR 1904.7(b)(4)(i)(B) and 29 CFR 1904.7(b)(5)).

29 CFR 1904.29(b)(2): The employer did not fill out or correctly fill out an OSHA Form 301 or equivalent for each recordable injury or illness:      a.  North American Coatings LLC, dba CL Industrial Coatings Inc. - On or about March 26, 2012 and at times prior to, an OSHA Form 301 or equivalent for an employee with work related contact dermatitis was not filled out correctly for an injury with a date of March 6, 2012.    The 301 equivalent forms did not contain the following information:  -  The title of the employee completing the form.  -  6) The name of the physician(s) treating the employee.  - 16) The case number from the OSHA 300 log.    The 301 equivalent forms was not completed, did not contain specific information or did not accurately complete the following:  -  8) Accurate information on whether the employee was treated in an emergency room.  Form states no when employee was seen in the emergency room.  - 13) The time of the event or the box stating it cannot be determined was not completed.  - 14) What the employee was doing just before the incident occurred. Such as spraying mix of Carbomastic 15 and Thinner 10 onto steel structure.  The employer documentation states painting rather than spraying a mix of Carbomastic 15 Parts A and B with Thinner 10.  - 15) What happened?  Such as overspray came into contact with skin during spraying.  Employer documentation states employee alleges he was exposed to Carboline paint on his arm, face and neck.; Paint.  - 17) What object or substance directly harmed the employee?  Such as: Carbomastic 15 and Thinner 10.  Employer stated Paint.
