29 CFR 1910.178(m)(5)(iii):     When the operator of an industrial truck was dismounted and within 25 feet of the truck still in his view, did not have the load engaging means fully lowered, controls neutralized, and the brakes set to prevent movement.    a) On Feburary 20, 2012, the forklift operator dismounted the Hytser 60 Forklift to repair previously set shipping load onto a over the road type flat bed truck. The forks were not lowered nor was the park brake set before dismount. While standing on the floor and on the left side of the fork lift the operator was able to reach across drivers seat, lower the forks to the ground and inadvertently hit the forward drive lever causing the forklift to move.

29 CFR 1910.178(l)(2)(ii):     The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    a) On or about March 28, 2012 and prior to this date, the employer did not ensure that employees who operate powered industrial vehicles were first trained to operate that equipment safely. Employees had not received lectures, testing, and classroom video observation and the post test evaluation of that content prior to operating forklift in Warehouse #15 on a daily basis, including but not limited to, the hazards of not properly setting the forklift brakes when dismounted from the forklift.

29 CFR 1910.178(l)(2)(i)(A):     Trainees operated a powered industrial truck without direct supervision of persons who have the knowledge, training, and experience to train operators and evaluate their competence.    a) On or about February 20, 2012 and prior to this date, the employer did not ensure that the trainees who operated and utilzed a probane powered Hyster 60 set down fork lift to load and unload material and freight in warehouse number 15 were being evaluated under the direct supervison of an experience trained operator during that work.
