29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face: a) On or about October 7, 2011 and at times prior, HTM Construction Company did not ensure that employees were protected from falling rock hazards. Employees were exposed to falling rocks due to inadequate protection measures being taken to address falling rock hazards. 1. The area was not scaled after major earth moving processes left loose rock on the excavation face directly above the company conex. 2. The wire mesh used to contain falling rocks was not installed above the area where the company conex was staged. Employees did access this area several times a day as this is where they stored tools, machines, and personal items. 3. No protective barricades were installed on the face of the slope to prevent loose rock from entering the work area.
