29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a) Main entrance area of the structure; On or about March 27, 2012, and at times prior thereto, as the controlling employer, a subcontractor's employees were accessing the 2nd level landing while performing miscellaneous carpentry work. The landing did not have guardrails or another means of fall protection in place.    b) Main entrance area of the structure; On or about March 27, 2012, and at times prior thereto, the superintendent was accessing the 2nd level landing to access the apartments. The stairway did not have a stairrail system in place.     b)  Main entrance area of the structure, 1st to 2nd level; On or about March 27, 2012, and at times prior thereto, the superintendent was utilizing a stairway to access the 2nd level apartments.
