Section 5(a)(1)  of the Occupational Safety and Health Act of 1970 : the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:    Work Barge located to the north of the I-70 Bridge over the Mississippi River- Between the period of June 2011 to March 28, 2012, a Genie N80 boom lift was placed on a barge and used by employees without following all manufacturers' requirements for safe use.    Feasible means of abatement include, but are not limited to:    Adhering to the Genie N80 boom lift Operations Manual which states, Do not use the machine on a moving or mobile surface or vehicle.  Following the requirements of ANSI/SIA A92.5-2006 for Boom-Elevated Work Platforms  section 8.10 (21) Unusual Operating Support conditions which states, The aerial platform shall not be operated from a position on trucks, trailers, railway cars, floating vessels, scaffolds, or similar equipment unless the application is approved in writing by the manufacturer or a qualified person..

29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    On or about March 28, 2012, employees working either on or around a Genie N80 boom lift were not trained on the requirements for safe operation of the equipment.  Employees were thereby exposed to fall, struck by and drowning hazards.

29 CFR 1926.20(b)(1):     The employer did not initiate and maintain such programs as may be necessary to comply with this part:    On or about March 28, 2012, the employers safety and health program did not include safe practices and procedures for the installation of pipe pilings.  Employees were thereby exposed to the hazards associated with the displacement of a piling.
