29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: Painters were exposed to inhalation hazards in that the written respiratory protection program was not worksite-specific. Painters performed multiple work tasks with a variety of respirators available and procedures including what type of respirator was required for each job task were not established.

29 CFR 1910.134(f): Fit testing. This paragraph requires that, before an employee may be required to use any respirator with a negative or positive pressure tight-fitting facepiece, the employee must be fit tested with the same make, model, style, and size of respirator that will be used. This paragraph specifies the kinds of fit tests allowed, the procedures for conducting them, and how the results of the fit tests must be used: Painters were exposed to inhalation hazards in that they were not fit tested before using the 3M-6800 full-face tight-fitting respirators.

29 CFR 1910.1026(j)(2)(ii): Dry shoveling, dry sweeping, and dry brushing may be used only where HEPA-filtered vacuuming or other methods that minimize the likelihood of exposure to chromium (VI) have been tried and found not to be effective: Painters were exposed to Chromium VI hazards in that dry sweeping of the floor was done routinely when cleaning the paint bays.
