29 CFR 1926.451(h)(2): Where there was a danger of tools, materials, or equipment falling from a scaffold and striking employees below, the provisions of paragraphs (h)(2)(i) - (v) of this section were not followed:      a)  Main entrance of the structure:  On or about March 27, 2012, and at times prior thereto, other subcontractor's employees were walking under the tubular welded scaffold being utilized for stucco work that was lacking toe-boards or other protective means to the entrance of the structure. 29 CFR 1926.451(b)(4): Each end of a platform, which was not cleated or otherwise restrained by hooks or equivalent means, did not extend over the centerline of its support by at least 6 inches:      a)  Main and side facade areas of the structure, at all levels of the scaffold;  On or about March 27, 2012, and at times prior thereto,  four employees performing stucco work were utilizing tubular welded frame scaffold that had unsecured planks bridging across from one stand of scaffold to another. One end of the planks did not extend at least 6 inches beyond their support.     Note:  Abatement certification IS required for this item.

Crossbraces were used as a means of access.      a)   Main and side facade areas of the structure, at all levels of the scaffold; On or about March 27, 2012, and at times prior thereto, four employees performing stucco work were climbing the end frames of the tubular welded frame scaffold as a means of access.    b)  Main and side facade areas of the structure, at all levels of the scaffold; On or about March 27, 2012, and at times prior thereto, four employees performing stucco work were climbing the crossbracing of the tubular welded frame scaffold as a means of access.    c)  Main and side facade areas of the structure, at the 1st level of the scaffold; On or about March 27, 2012, and at times prior thereto, an employee performing stucco work jumped from the tubular welded frame scaffold down to the ground.
