OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to:    Lockhart Concrete Company Inc., on March 27, 2012, had an employee fatally crushed between the rear of the excavator and a stack of concrete panels located in the swing radius of the excavator, which was not barricaded to warn and prevent employee entrance. Among the feasible means of abatement would be to comply with the Association of Equipment Manufactures for Hydraulic Excavators requirements for swing radius protection.     ***Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c)***

29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    On or about 3/27/12, the employer did not ensure employees were provided training in the recognition and avoidance of unsafe conditions including pinch point crushing injuries. A hydraulic excavator was operating in an area in close proximity to employees and was not properly guarded or barricaded. An employee of Lockhart Concrete Company was fatality injured when the rear of the 2006 Caterpillar 330DL (Serial # MWP00880) hydraulic excavator swung and pinned the employee between a stack of concrete panels used for a retaining wall system.
