Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees were exposed to fall hazards while being elevated on a bucket attachment of an all-terrain forklift. Feasible and acceptable methods of abatement to correct this hazard include, but are not limited to the following: (1) Conform to the American National Standard Institute (ANSI) for Rough Terrain Forklift Trucks, ANSI/ITSDF B56.1-2009, Paragraph 4.17. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) The employer did not ensure that the operators of the Gradall 534B all terrain forklifts were evaluated and competent to operate the powered industrial trucks. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
