29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs,and other elevated surfaces are set forth in subpart M of this part. At the site, a worker was assisting with carpentry framing while standing on top of a 2-tiered mobile scaffold, which did not have guard rails. This condition exposed the employee to fall hazards of approximately 13 feet.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and verticalsurface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrailsystems, safety net systems, or personal fall arrest systems. At the site, an employee was standing on the top plate performing carpentry framing work on a wood-frame restaurant under construction. This condition exposed the employee to fall hazards of approximately 12 feet. T.C. CONSTRUCTION, LLC, WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 316043728, CITATION NUMBER 2, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 30, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 4650 N. TARRANT PARKWAY, IN FORT WORTH, TEXAS 76248.
