29 CFR 1926.451(g)(1):   Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.    Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.    a)	 Fraco scaffold, north side of building, east end   Employees without fall protection (no guardrail opposite the ladder access area) were exposed to approximate 22 fall to the ground below when accessing the scaffold using the 40 yellow extension ladder, on or about 03/23/12;    b)	Fraco scaffold, north side of building, eastern most mast (#1)  Employees without fall protection (area north of mast #1) were exposed to approximate 22 fall to the ground below when walking from one end of the platform to another, on or about 03/23/12;    c)	Fraco scaffold, north side of building, west of mast #2  Employees without fall protection (approximately 7 of guardrail removed approximately 13 west of mast #2) were exposed to approximate 22 fall to the ground below when walking from one end of the platform to another, on or about 03/23/12;    d)	Fraco scaffold, north side of building, west of mast #3  Employees without fall protection (approximately 7 of guardrail removed approximately 17 west of mast #3) were exposed to approximate 22 fall to the ground below when walking from one end of the platform to another, on or about 03/23/12;    e)	Fraco scaffold, north side of building, west of mast #4  Employees without fall protection (approximately 34 of guardrail removed just west of mast #4) were exposed to approximate 22 fall to the ground below when walking from one end of the platform to another, on or about 03/23/12;    f)	Fraco scaffold, north side of building, west of mast #4  Employees without fall protection (approximately 8 of guardrail removed just west of mast #4) were exposed to approximate 22 fall to the ground below when walking from one end of the platform to another, on or about 03/23/12;    g)	Fraco scaffold, north side of building, south side of scaffold, adjacent to and running east of mast #2 - Employees without fall protection (approximately 30 opening in the wall adjacent to the working area) were exposed to approximate 22 fall to the ground below when walking from one end of the platform to another, on or about 03/23/12. 29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    a)	Mays Landing Walmart construction site: Employees without proper fall protection working at heights of approximately 22 either did not know or had forgotten the requirements for fall protection when working from scaffold platforms at heights greater than 10, on or about 03/23/12.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS  REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
