29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork: The employer does not ensure that the entire platform is securely attached to the forks when forklifts are used to support scaffold platforms. This violation was observed on or about March 22, 2012 on the east side of the structure where an employee was exposed to a fall hazard while using a platform that wasn't adequately attached to the forks. Pursuant to 29 C.F.R 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the entire platform is attached to the forks when using a forklift to support scaffold platforms.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. The employer does not provide a fall protection system for employees working 6 feet or more above a lower level. This violation was observed on or about March 22, 2012 on the east side of the structure where: a. An employee was exposed to a fall of 13 feet while working from the top of the porte cochere frame. b. An employee was exposed to a fall of 8.5 feet while working from a horizontal beam of the porte cochere frame. c. An employee was exposed to a fall while working from a platform that was being supported by an Xtreme telescoping forklift. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provided with a fall protection system when working at heights of 6 feet or more above a lower level.
