29 CFR 1910.178(o)(1): The employer did not ensure that only stable or safely arranged loads were handled: a) Yard: Employees were exposed to hazards due to the unstable loads on forklifts. Powered industrial vehicles, specifically the Caterpillar / Mitsubishi mod. DPL 40 ser#4CN10168, routinely lift, transport and empty the scrap bins while the handled load is unstable. This resulted in a bin falling from the PIV forks, injuring an employee. Observed on or about 03/29/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
