29 CFR 1910.1030(c)(1)(iv)(B):     Document annually consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure.      At the work site, the employer's exposure control plan did not contain documented annual review of devices designed to minimize employee exposure to blood-borne pathogens.  Employees who worked as paramedics were provided needles that were not self-sheathing for starting IVs on patients.

29 CFR 1910.1030(c)(1)(v):     An employer, who is required to establish an Exposure Control Plan shall solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation, and selection of effective engineering and work practice controls and shall document the solicitation in the Exposure Control Plan.    At the work site, the employer did not involve employees with exposure to blood borne pathogens in the evaluation and selection of IV needles.  Employees who worked as paramedics and emergency medical technicians (EMTs) started IVs on patients during transport and treatment.

29 CFR 1910.1030(g)(2)(i):     The employer shall train each employee with occupational exposure in accordance with the requirements of this section. Such training must be provided at no cost to the employee and during working hours. The employer shall institute a training program and ensure employee participation in the program.    The employer did not have a formal training program for employees with occupational exposure to blood and bloodborne pathogens.  Employees who worked as paramedics and emergency medical technicians (EMTs) to treat and transport patients had not received any training on blood borne pathogens.
