Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire/explosion hazards: (a) On or about March 29, 2012, an employee operating a diesel pump unit received burn injuries as a result of the ignition of hydrocarbon vapors. The employer installed diesel engine pump skid units serving as ignition sources, approximately 64 feet from an open top flow back tank equipped with a gas buster, and did not ensure that all equipment, including those provided by third party special services, intended to prevent flash fires was functioning as required. At the Obenour 150-99-28-33-1H well site, located approximately four miles west of Watford City, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements of American Petroleum Institute - Recommended Practice 54, Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations, Paragraph 12.1.8, Discharges of oil or gas to the atmosphere should be to a safe area, preferably on the downwind side of the well and a minimum of 100 feet (30.5 m) from the wellhead, open flame, or other sources of ignition.
