29 CFR 1926.20(b)(3):     The use of any Machinery, tool(s), material(s), or equipment which was not in compliance with the applicable requirement(s) of 29 CFR 1926 was not prohibited, and such Machinery, tool(s), material(s), or equipment  was neither  identified as unsafe by tagging, or locking the controls to render them inoperable, nor were they physically removed from its place of operation:    a) On or about 04/02/12, at the "7 Block Area", on Greenpac Mill Construction Project at 4400 Royal Ave., Niagara Falls, NY: A Ridgid Drillmotor with a mixing paddle attached became coated with a sticky resin/powder mixture that caused the drill to malfunction. One employee used a hammer in an attempt to free the trigger and another employee grabbed & pulled on the paddle. The drill started up and the employee's hand got caught up in the rotating paddle shaft causing severe injuries to his fingers.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.416(e)(1):     Worn or frayed electric cords or cables were used:    a) On or about 04/02/12, at the "7 Block Area", on Greenpac Mill Construction Project at 4400 Royal Ave., Niagara Falls, NY: A Ridgid Drillmotor with a mixing paddle attached was used to mix a resin/powder mortar mix. The Drillmotor was connected to 110-volt ac power via a series of two extension cords. The outer sheath of the first extension cord was frayed at the plug end, exposing the conductors.     NO ABATEMENT CERTIFICATION REQUIRED
