OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: a) On or about April 3rd, 2012, yard personnel were allowed to stand in the immediate area to, amongst other things, remove debris from containers while they were suspended in the open position. Employees were thereby exposed to crushing hazards in the event the container unexpectedly closed. b) On or about April 3rd, 2012, an employee positioned himself beneath the hydraulic lifting device of the Dempster Dumpster truck to ensure that the latch mechanism was engaged, and was exposed to crushing hazards in the event the hydraulics failed. Abatement Certification and Abatement Documentation Required.
