OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to crushing/struck-by hazards: On or about February 21, 2012, an employee was exposed to crushed-by hazard while reassembling the rear coil springs on a Jeep four wheel drive vehicle supported by jack stand(s). A jack stand failed and the Jeep fell on employee causing serious injuries to the employees upper torso and arms.

29 CFR 1910.244(a)(1)(ii): The rated load was not legibly and permanently marked in a prominent location on the jack bycasting, stamping, or other suitable means. On or about April 4, 2012, four hydraulic floor jacks were observed at Alamo Auto Supply automotive bay with no weight capacity markings. This exposed the employees to struck-by and/or crush-by hazards.
