29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. On or about February 03, 2012 and at times prior thereto, employees were exposed to a fall of approximately 26 feet to the gravel below while sheathing a roof without fall protection.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever was less, were not equipped with one stair rail system along each unprotected side or edge: On or about February 03, 2012 and at times prior thereto, employees were exposed to a fall of approximately 10 feet to the concrete below while using an unguarded stairway to access the upper level and roof.
