29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Employees in the Grind department noise levels exceeded 85 dBA and were not part of an hearing conservation program: a) Employee was exposed to 87.8 dBA, as a calculated 8 hour time weighted average. The employee was sampled on April 11, 2012 for 8 hours and 29 minutes. b) Employee wsa exposed to 87.96 dBA, as a calculated 8 hour time weighted average. The employee was sampled on April 11, 2012 for 9 hour 16 minutes.
