29 CFR 1926.52(b): Employees were subjected to sound levels exceeding those listed in table D-2 of 29 CFR 1926.52 and feasible administrative or engineering controls were not utilized to reduce sound levels:    (a) On or April 4, 2012, in the Franklin D. Roosevelt Library, for an employee using a Sullair MPB 60A 1.25 diameter hammer to break up the concrete floor in the southeast wing, without equipping the hammer with an optional muffler or silencer, available from the manufacturer. This worker was exposed to 439% of the allowable dose measured on a 90 dBA dosimeter or an equivalent sound level of 101 decibels measured for 225 minutes on April 4, 2012. Zero exposure was assumed for 255 minutes.    (b) On or about April 4, 2012, in the Franklin D Roosevelt Library, for an employee shoveling concrete debris and using a hose to keep the dust while a worker was breaking up the concrete floor in the southeast wing. This worker was exposed to 384% of the allowable dose measured on a 90 dBA dosimeter or an equivalent sound level of 100 decibels measured for 216 minutes on April 4, 2012. Zero exposure was assumed for 264 minutes. Administrative controls such as but not limited to employee rotation to other jobs, such as working outside on the conveyor unloading the debris, were not utilized.     (c) On or about April 4, 2012, in the Franklin D Roosevelt Library, for an employee shoveling concrete debris and using a hose to keep the dust down while a worker was breaking up the concrete floor in the southeast wing. This worker was exposed to 349% of the allowable dose measured on a 90 dBA dosimeter or an equivalent sound level of 99 decibels measured for 213 minutes on April 4, 2012. Zero exposure was assumed for 267 minutes.   The administrative control of employee rotation to less noisy jobs was not employed.

Components of an effective hearing conservation program include but are not limited to conducting noise surveys, establishing a training program for noise, providing a variety of hearing protectors and establishing an audiometric testing program.

29 CFR 1926.62(d)(2)(v)(A): Until the employer performed an employee exposure assessment as required under 29 CFR 1926.62(d) and determined actual employee exposure, the employer did not provide to employees performing the tasks described in 29 CFR 1926.62(d)(2)(i), (d)(2)(ii), (d)(2)(iii), and (d)(2)(iv) with appropriate respiratory protection in accordance with 29 CFR 1926.62(f):      a) On or about March-April 2012, in the southeast wing, zone 4 of the basement of the library, for workers sledge hammering interior walls coated with a lead surface and picking up the debris.
