29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces: NOTE: A sign reading DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign. On March 5, 2012, Maplehurst Farms Inc. employees were not warned of the hazards associated with entry into the dump pit tunnel access that was designated as a permit required confined space. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.146(e)(1): Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit: Note: Appendix D to 29 CFR 1910.146 presents examples of permits whose elements are considered to comply with these requirements. On or about March 5, 2012, Maplehurst Farms, Inc. employees acessed a dump pit tunnel without completion of an entry permit that would document measures had be taken such as, but not limited to, testing the atmosphere to verify that a safe entry could be made into the work area. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
