29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): (a) The written Lock Out/Tag Out program provided by the employer for the maintenance employee was inadequate in that it did not include the information contained in paragraphs A-D, procedures for periodic inspection and and procedural steps for equipment with multiple energy sources. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1904.33(b)(1): The employer did not update the OSHA 300 Log during the five-year storage period to include newly discovered recordable injuries or illnesses and to show any changes that have occurred in the classification of previously recorded injuries and illnesses. On or about April 10, 2012 the employer did not maintain the stored OSHA 300 logs by updating work-related injuries or illnesses on the OSHA Form 300 or equivalent for the calendar year 2010. (a) On or about July 19, 2010 a recordable injury occurred when a certified nursing assistant injured their lower back when lifting a resident, which resulted in 56 days of restricted duty and the injury was not recorded on the OSHA 300 log. (b) On or about September 27, 2010 a recordable injury occurred when a certified nursing assistant injured their right finger by getting it caught between a piece of equipment and the wall, which resulted in 3 days of restricted duty and the injury was not recorded on the OSHA 300 log.
