OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to a caught in between hazard.    a) Ditch grounds behind Burlington Center Mall (East side): An employee operated a Kubota Tractor model B2400 without a seatbelt, on or about 4/5/12.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.178(l)(2)(ii): Training did not consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operators performance in the workplace.    a) Ditch grounds behind Burlington Center Mall	(East side): The employer did not ensure that each operator of the Kubota Tractor model B2400 was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation, on or about 4/5/12.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
