29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) Monroe Avenue Associates Building, 3750 Monroe Avenue, Pittsford, NY., the site was lacking a competent person as evidenced by the lack of cave-in protection, accumulation of water, the placement of the backhoe and spoil pile to the edge of the trench which was sluffing off. These conditions should not have existed if a competent person was on site and performing his duties as required. ABATEMENT CERTIFICATION REQUIRED
