OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:      On or about April 04, 2012, employees working in and around an excavation were riding the load as it was lifted by an excavator and lowered into the excavation. Employees were exposed to fall hazards.

Employees were exposed to falling object and struck-by hazards.

29 CFR 1926.251(b)(1): Welded alloy steel chain slings did not have permanently affixed durable identification stating size, grade, rated capacity, and sling manufacturer:      On or about April 04, 2012, employees were utilizing a 1/2 inch steel alloy chain 16 ft in length  that had no identification or capacity markings to lift a concrete lift station and exposed to struck-by hazards.

1926.251(b)(6)(i): In addition to the inspection required by other paragraphs of this section, a thorough periodic inspection of alloy steel chain slings in use were not made on a regular basis, to be determined on the basis of frequency of use;severity of service conditions; nature of lifts being made; and experience gained on the service life of slings used in similar circumstances. Such inspections were in no event made at intervals greater than once every 12 months.       On or about April 04, 2012, a 1/2 inch steel alloy chain 16 foot in length was used, to hoist a concrete lift station, was not inspected prior to use and exposed employees to struck-by hazards.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:      On or about April 04, employees were performing plumbing work within an excavation that did not have a safe means of egress. The employees were exposed to crush-by hazards in the event of a cave-in.
