29 CFR 1926.451(g)(1)(i):     Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:    a) On or about 04/11/12, at a residential home undergoing a roof replacement 41 Rabin Terr., Buffalo, NY:  A continuous ladder jack scaffold was erected on the south side of the house. Two employees were on the 12 inch wide "pik" of the scaffold and were installing the first courses of roofing shingles. Each employee was exposed to a fall of approx. 18 ft. to the ground. Each employee was wearing a full body harness, but they were not tied off to an anchor point.    b) On or about 04/11/12, at a residential home undergoing a roof replacement 41 Rabin Terr., Buffalo, NY:  A ladder jack scaffold was erected on the east side of the house. An employee was on the 12 inch wide"pik" of the scaffold  and installed the first courses of roofing shingles on the lower roof. The employee was exposed to a fall of approx.  11 ft. to the ground. The employee was wearing a full body harness, but was not tied off to an anchor point.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.454(a):     The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.      a) On or about 04/11/12, at a residential home undergoing a roof replacement 41 Rabin Terr., Buffalo, NY:   Employees installing roofing shingles while standing on the "pik" of ladder jack scaffolds were exposed to falls of up to approx. 18 ft. The employees  were not trained to recognize the hazards associated with the type of scaffold and the OSHA regulations to control or minimize those hazards.    ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.503(a)(1):     The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed inorder to minimize these hazards.      a) On or about 04/11/12, at a residential home undergoing a roof replacement 41 Rabin Terr., Buffalo, NY:   Employees installing a replacement roof were exposed to falls of approx. 18 ft. from the roof edge. The employees  were not trained to recognize the hazards associated with the type of roofing work and the OSHA regulations to control or minimize those hazards.    ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fallprotection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complieswith 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.      a) On or about 04/11/12, at a residential home undergoing a roof replacement 41 Rabin Terr., Buffalo, NY:   Employees installing a roof above the garage with a pitch of approx. 10  in 12 were exposed to a fall of approx. 18 ft. Some of  the employees were wearing a full body harness, but had no lanyard attached. One of the employees had neither a harness nor lanyard. There were no roof anchors installed on the roof, and none of the employees was tied off to anything. Slide guards with 2x6 lumber were installed along the eave on the south side of the roof. No guardrail system, safety net system, or other fall protection system was utilized.    NO ABATEMENT CERTIFICATION REQUIRED
