29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one-half horizontal to one vertical.    (a) On or about 04/10/2012 at 1 Park Avenue, Piscataway, NJ 08854: The employer allowed employees to work in an excavation/trench that was 15' long x 4' wide x 6'7" deep with no cave-in protective system in place, i.e. trench shield, shoring, and or sloping in place to prevent collapse.

29 CFR 1926.651(k)(2):     Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    (a) On or about 04/10/2012 at 1 Park Avenue, Piscataway, NJ 08854: The employers competent person allows employees to work in an excavation/trench with no cave-in protective system in place, i.e. trench shield, shoring, and or sloping in place to prevent collapse.  Employees were working in a trench that was 15' long x 4' wide x 6'7" deep and were not removed until competent person observed Compliance Officer approching the site.
