29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) Ted Thomas, conducting work at 3222 Pickle Rd., Oregon, OH: On or about April 11, 2012, the employer did not ensure that employees were protected from head injury hazards by protective hard hats while working below employees who were replacing 4/12 pitch roof of the one story residential building. Employees were exposed to potential impact injuries caused by falling materials and/or equipment.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

Employees were exposed to fall hazards of approximately 9 feet from the roof to the ground below. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a) Ted Thomas, conducting work at 3222 Pickle Rd., Oregon, OH: On or about April 11, 2012, the employer failed to ensure that employees had been trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection while replacing 4/12 pitch roof of the one story residential building. Employees did not use fall protection and were exposed to fall hazards of approximately 9 feet from the roof to the ground below.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a) Ted Thomas, conducting work at 3222 Pickle Rd., Oregon, OH: On or about April 11, 2012, the employer did not ensure that the extension ladder, used to access the roof of the one story residential building, was extended at least 3 feet above the roof edge. The employees were exposed to fall hazards of approximately 9 feet from the ladder to the ground below when using the ladder to access the working level in order to conduct roofing activities.    No additional abatement information is needed for this item.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.    a) Ted Thomas, conducting work at 3222 Pickle Rd., Oregon, OH: On or about April 11, 2012, the employer did not ensure that employees, using the extension ladder to access the roof of the one story residential building in order to conduct roofing activities, were trained to recognize the hazards associated with the ladders use and to understand the procedures to control or minimize those hazards. Employees did not extend the ladder at least 3 feet above the roof edge and were exposed to fall hazards of approximately 9 feet from the ladder to the ground below.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
