29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On or about 04/12/2012, and at times prior thereto, at facility, for the employees wearing North and MSA half-face respirators with P100 cartridges while working in mulch pile during grinding operation containing substances such as, wood dust. The employees were not provided a medical evaluation prior to being required to wear the respirator. Perfect Cut Tree Service was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard (1910.134(e)(1)) which was contained in OSHA inspection #313759227, Citation 1, Item 3a. This citation was issued August 05, 2010, became a final order on August 26, 2010 and had final abatement day of September 08, 2010. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED FOR THIS ITEM

29 CFR 1910.134(f)(2): The employer did not ensure that employees using a tight-fitting facepiece respirators pass an appropriate qualitative or quantitative fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: (a) On or about 04/12/2012, and at times prior thereto, at facility, for the employees wearing North ans MSA half-face respirators with P100 cartridges while working with mulch pile during grinding operation containing substances such as, but not limited to, wood dust. The employees were not fit tested, either qualitatively or quantitatively, prior to being required to use this respirator by the employer.
