29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a) Luis Callejas, worksite located on 1000 Michigan Street in Sidney, OH:  On or about April 13, 2012, the employer did not ensure employees were wearing proper eye protection while operating a Bostitch pneumatic nail gun to secure new shingles to a residential structure. Employees were exposed to potential flying object hazards while operating the nail gun.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.    a)  Luis Callejas located at worksite on 1000 Michigan Street in Sidney, OH: On or about April 13, 2012, the employer did not assure that employees wearing fall protection and exposed to fall from heights that ranged from 12 to 17 feet were secured to an anchoring point while conducting shingle operations on a 6/12 pitched commercial structure.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:    a) Luis Callejas, located at worksite on 1000 Michigan Street in Sidney, OH: On or about April 13, 2012, the employer did not ensure that employees were trained in the proper application of personal fall protection equipment while working on a 6/12 pitched commercial structure. Employees were exposed to a fall from height that ranged from 12 to 17 feet from the pavement below.
